Ken Pierce obtained a unanimous defense verdict after a two day trial in the Penobscot County Superior Court on March 12, 2019. In Carol Jewell v. Colleen Kinsella and Tamara Elsenheimer, Docket Number CV-18-56, Plaintiff alleged that her injuries were caused by two separate accidents. The first accident happened while Plaintiff was a passenger in an RV on the Maine Turnpike. In the second, Pierce’s client Tammy Elsenheimer, struck Plaintiff’s vehicle after being waved across stopped traffic by another driver. Ms. Elsenheimer acknowledged that she was solely at fault for the collision but argued that neither accident, separately nor combined, caused Plaintiff’s injuries. The jury agreed. Ms. Elsenheimer was insured by State Farm.
