RECENT VICTORIES 2009

In a recent battle between personal auto carriers in the Maine Superior Court, Erica Johanson recovered $50,000 from Allstate Insurance Company for Vermont Mutual Insurance Company.  She successfully argued that possible intent to purchase a vehicle and possession of that vehicle for a couple of months does not constitute a transfer of ownership.  The personal auto insurer for the vehicle, Allstate, asserted that its coverage did not apply to an accident because the driver had kept the vehicle for a couple of months while he decided whether to buy it from Allstate's insured.  The Court ruled that ownership of the vehicle had not transferred because Allstate's insured had left his license plates on the vehicle and had continued to insure the vehicle, a bill of sale had not been executed, and title had not been transferred to the driver.
