RECENT VICTORIES 2009
In December of 2009, Ken Pierce successfully argued before a Cumberland County jury on behalf of the Defendant, a dog owner, in an effort to significantly reduce the amount of the verdict awarded to the Plaintiff due to a slip and fall accident. Plaintiff, a 76 year old woman, suffered injuries and claimed medical specials and lost wages as a result of a fall caused by two dogs secured to an industrial waste bin at the convenience store. Defendant stipulated to liability. At a Judicial Settlement Conference prior to trial, Plaintiff demanded $175,000, and Defendant's insurance company offered to pay $140,000.00. At trial Plaintiff alleged damages in the amount of $250,000.00. The jury ruled that the damages were $125,000.00, one-half of Plaintiff's claimed damages and significantly less than the pre-trial offer made by the insurance company.
